TERMS & CONDITIONS
RIGHTS AND USAGE
By virtue of this agreement, Oregon Media, LLC buys limited rights and electronic rights to the work described for one year from submission date. The photo(s) may not be sold/published in any competing publications that is distributed in the Central Oregon ti-county area or their digital and social media outlets during that one year. Photos may be used by Oregon Media, LLC for any purposes other than the original printing that are related to Oregon Media, LLC, including but not limited to other publications owned by Oregon Media, LLC, promotions, and advertising, including digital use (website, social media platforms, etc) during the one year Oregon Media, LLC usage agreement. The photographer may publish the photo(s) on their own digital and social media outlets. After the one year exclusive use agreement expires, Oregon Media, LLC may still use the photos indefinitely, but no limitations for photographer use still apply.
WARRANT OF ORIGINALITY
Photographer represents and warrants to Oregon Media, LLC that he or she is the sole creator of the photographs and has the unimpaired right to convey to Oregon Media, LLC the Rights and Images described in this agreement. The photographer agrees to indemnify and hold harmless the publisher against any claim, demand, lawsuit or proceeding that might be brought against publisher by reason of any of the following matters regarding the photographer’s images: a) any violation or infringement of any proprietary right or copyright of any institution or individual(s); b) any libelous or unlawful matter contained in the photos; c) any invasion of the rights of privacy or other personal rights possessed by any person or entity, including illegal trespass by the photographer and/or crew while obtaining said images on location; d) photographer’s breach of any term, covenant, representation or warranty of this agreement; e) anything whatsoever that might prejudice the securing to publisher or his assignees of the full benefit of rights herein granted. In the event of any legal proceeding related to the above-referenced images, photographer agrees to fully cooperate with Oregon Media, LLC in the defense thereof by counsel selected by Oregon Media, LLC.
DELIVERY All
high resolution photos must be saved in a TIF (preferred) or JPG digital format (300 DPI or greater at 100% dimension at 9.25 inches X 11.125 inches). Photographer must divulge if image was manipulated beyond normal color correction in order to achieve final image. Publisher requests that photos are submitted via email attachment to neg@bertbazrqvn.pbz
EDITING
Photographer agrees that Oregon Media, LLC will have the right to crop, digitally retouch, and/or apply tones to images, and that publication of the images will be solely at the discretion of Oregon Media, LLC.
CONFIDENTIALITY
Photographer agrees to keep confidential all details of the assignment, except people germane to his/her assignment until the photos have been published. This includes no reference of his/her work on Twitter, Facebook or other social media until the photos have been published.
PAYMENT
Payment fee (as listed above) for accepted images is made within 30 days following the next calendar publication date, regardless of when the photos will run. The fee is the total amount to be paid. No other costs will be paid unless approved in writing by Oregon Media, LLC.
